Terms of Service

Welcome to The Lotus Pod (“Platform,” “we,” “us,” or “our”), operated at lotuspod.net. By accessing or using the Platform, you (“you” or “User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 13 years of age to create an account. If you are between 13 and 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to request verification of age at any time and to terminate accounts that do not meet this requirement.

2. Account Registration & Security

  • You must provide a valid email address and choose a unique username.
  • You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
  • You agree to notify us immediately of any unauthorized use of your account.
  • We reserve the right to refuse registration, suspend, or terminate any account at our discretion.
  • Accounts are for individual use only. Sharing accounts is prohibited.

3. User Conduct

By using the Platform you agree not to:

  • Post, upload, or transmit content that is illegal, threatening, defamatory, obscene, hateful, or that promotes violence against any individual or group.
  • Harass, bully, stalk, intimidate, or threaten other users.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Post spam, chain messages, pyramid schemes, or unsolicited advertising.
  • Upload content that infringes on any third-party intellectual property rights.
  • Attempt to access other users’ accounts, private data, or admin functionality without authorization.
  • Use bots, scrapers, or automated tools to access the Platform without prior written permission.
  • Circumvent or interfere with any security features of the Platform.
  • Upload files containing malware, viruses, or other harmful code.
  • Use the Platform for any activity that violates applicable local, state, national, or international law.

4. User-Generated Content

4.1 Ownership

You retain ownership of all content you post on the Platform, including text, images, reviews, tier list rankings, forum posts, chat messages, gallery uploads, and marketplace listings (collectively, “User Content”).

4.2 License Grant

By posting User Content, you grant The Lotus Pod a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, modify (e.g., resize images), and distribute your User Content solely for the purpose of operating and improving the Platform. This license ends when you delete your content, except where it has been shared with others who have not deleted it, or where retention is required by law.

4.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful to the community. We are not obligated to monitor all content but may do so at our discretion.

4.4 Reporting

Users may report content they believe violates these Terms using the reporting tools provided on the Platform. We will review reports and take action as we deem appropriate, but we are not obligated to take any specific action.

5. Marketplace

5.1 User-to-User Transactions

The Marketplace facilitates user-to-user transactions. The Lotus Pod is not a party to any transaction between buyers and sellers. We do not inspect, verify, endorse, or guarantee any listing, item, or user.

5.2 Listing Accuracy

Sellers are solely responsible for the accuracy of their listings, including descriptions, images, pricing, and condition. Misrepresenting items is a violation of these Terms and may result in account suspension.

5.3 Payments

All payments between buyers and sellers occur outside the Platform through third-party payment services (e.g., PayPal). We do not process, hold, or facilitate payments. We strongly recommend using payment methods that offer buyer protection (such as PayPal Goods & Services). Use of non-protected payment methods (Venmo, Cash App, Zelle, cryptocurrency, gift cards) is at your own risk.

5.4 Disputes

While we provide a dispute resolution tool as a courtesy, we are under no obligation to mediate or resolve disputes between users. Our dispute resolution is non-binding. For payment disputes, contact your payment provider directly.

5.5 Prohibited Items

Listings for the following are strictly prohibited: illegal substances, weapons, counterfeit goods, stolen property, items that infringe on intellectual property rights, and any item whose sale violates applicable law.

6. Chat & Direct Messages

Chat rooms and direct messages are provided for community interaction. Messages may be retained on our servers for a reasonable period to provide the service. Admins may view and moderate public chat room messages. Direct messages are private between participants but may be reviewed in response to reports of abuse or violations of these Terms.

7. Intellectual Property

The Lotus Pod name, logo, and all Platform-original design elements are the property of The Lotus Pod. References to third-party artists, albums, bands, and record labels (including but not limited to Insane Clown Posse, Twiztid, and Psychopathic Records) are used for community discussion purposes and belong to their respective owners. We are not affiliated with, endorsed by, or sponsored by any of these entities.

8. Third-Party Services

The Platform integrates with third-party services including Spotify and various payment providers. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

9. Moderation & Enforcement

We may, at our sole discretion, take any of the following actions for violations of these Terms:

  • Issue warnings.
  • Mute your account (restrict posting abilities).
  • Temporarily or permanently suspend (“ban”) your account.
  • Remove content.
  • Revoke seller privileges.
  • Report illegal activity to law enforcement.

We are not required to provide advance notice before taking enforcement action, though we will generally attempt to explain the reason for any action taken.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

WE DO NOT ENDORSE, VERIFY, OR GUARANTEE ANY USER CONTENT, MARKETPLACE LISTING, USER IDENTITY, OR TRANSACTION. YOU INTERACT WITH OTHER USERS AT YOUR OWN RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LOTUS POD AND ITS OPERATORS, DEVELOPERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, ANY USER CONTENT, ANY MARKETPLACE TRANSACTION, OR ANY CONDUCT OF OTHER USERS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR TEN DOLLARS ($10.00), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless The Lotus Pod and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising out of or related to: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; (d) your violation of any rights of another; or (e) any Marketplace transactions you participate in.

14. Account Termination

You may delete your account at any time by contacting an administrator. Upon termination, your right to use the Platform ceases immediately. We may retain certain data as required by law or for legitimate business purposes (e.g., dispute resolution, fraud prevention).

15. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes by posting a notice on the Platform or via email. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
